Terms of sale

1. Scope and seller

These terms of sale govern every purchase made on loafersavenue.com. The seller is IMMOTO, a French simplified joint-stock company (société par actions simplifiée) with a share capital of €1,000, registered office 53 Rue des Alouettes, 92000 Nanterre, France, registered with the Nanterre trade register under number 990 084 220 (SIRET 990 084 220 00013), intra-community VAT number FR55990084220, trading as Loafers Avenue. They apply to consumers buying for purposes outside any trade or profession. Placing an order means you accept them; the version that applies is the one in force on the day you order.

2. The products

We sell loafers and related footwear. The essential characteristics of each pair — style, upper and lining materials, sole, available sizes and colours — are set out on its product page, in the description and in the Details section. Photographs are indicative: a colour can look slightly different from one screen to another, and that difference alone is not a defect.

Our offer is valid while the pair is displayed as available. If a size sells out between your order and dispatch, we tell you and refund that line in full.

3. Prices

Prices are shown in pounds sterling and include all taxes due. Delivery within the United Kingdom is free, with no minimum spend, so the total shown at checkout is the total you pay. Your order is shipped on a delivered-duty-paid basis: the carrier will not ask you for anything on delivery.

We may change our prices at any time, but the price that binds us is the one displayed when you place your order.

4. Placing an order

You add a pair to your basket, check the contents, enter your delivery and billing details, choose a payment method, and confirm. The confirmation step is where the contract is formed: before it you can go back and change anything, and the button that completes it states that it carries an obligation to pay.

We send you an order confirmation by email. Keep it: it is your proof of purchase. If you do not receive it within a few hours, check your spam folder and then write to us.

We may refuse or cancel an order in the event of an obvious pricing or description error, a stock shortage, a payment refused by your bank, or a reasonable suspicion of fraud. If we do, you are refunded in full and owe us nothing.

5. Payment

Payment is due in full when you order. It is taken at checkout through Shopify Payments and the providers shown at the foot of the page — card, Apple Pay, Google Pay, PayPal and Shop Pay. We never see or store your full card details.

Your order is dispatched once payment is confirmed. The goods remain our property until we have received payment in full; risk passes to you on delivery, as set out below.

6. Delivery and risk

We ship across the United Kingdom, to the address you give at checkout. Delivery takes 6 to 9 business days: 1 to 2 business days for order processing and 5 to 7 business days for transit. The estimated delivery date is shown at checkout before you pay.

Risk of loss or damage passes to you when the parcel is delivered to you or to a person you have designated. If a parcel is lost or damaged in transit, tell us and we resend or refund it — that is our responsibility, not yours.

Please check your address at checkout. Once a parcel is dispatched it cannot be redirected. Full detail is in our shipping policy.

7. Right to cancel

You have 14 days from the day you, or a person you designate, take physical possession of the goods to cancel your order without giving a reason and without penalty. Where an order is delivered in several parcels, the period runs from the last one.

To exercise the right, tell us clearly before the 14 days expire — an email to contact@loafersavenue.com is enough. You may use the model form below, but you do not have to. Then send the goods back within 14 days of telling us.

We pay the return postage. We send you a prepaid label; you have nothing to pay to return a pair. You are only liable for any loss of value resulting from handling the goods beyond what is needed to establish their nature, characteristics and functioning — in practice, trying them on indoors is fine, wearing them outside is not.

We refund you within 14 days of receiving the goods back, using the same means of payment you used, unless you expressly agree otherwise. Beyond this legal right, we give you 30 days in total to change your mind — see our refund policy for the full terms.

9. Legal guarantees

Every pair we sell comes with the legal guarantees below, at no cost to you, in addition to any commercial gesture we may make. They apply whatever our refund policy says, and nothing in these terms reduces them.

Guarantee of conformity. Under articles L.217-3 and following of the French Consumer Code, we must deliver goods that conform to the contract and we answer for any lack of conformity existing at delivery, for two years. During that period you may ask for the goods to be repaired or replaced, and, if that is impossible or fails, for a price reduction or a refund. For the first twelve months you do not have to prove that the defect existed at delivery — it is presumed.

Guarantee against hidden defects. Under articles 1641 and following of the French Civil Code, you may also claim for a hidden defect that makes the goods unfit for their intended use, within two years of discovering it, and obtain a refund or a price reduction.

If you live in the United Kingdom, your rights under the Consumer Rights Act 2015 — including the short-term right to reject faulty goods within 30 days — and under the Consumer Contracts Regulations 2013 apply and are unaffected by these terms.

To make a claim, write to contact@loafersavenue.com with your order number and photographs. We arrange the return at our expense.

10. Force majeure

Neither of us is liable for a failure to perform caused by an event beyond our reasonable control. If such an event lasts more than 30 days, either of us may cancel the order and you are refunded in full.

11. Complaints

Write to contact@loafersavenue.com or call +33 6 71 32 27 65. We answer within 1 business day, Monday to Friday, 9am to 6pm London time, and most matters are settled within a few days.

12. Governing law and jurisdiction

These terms are governed by French law. This choice cannot deprive you of the protection given to you by the mandatory rules of the law of the country in which you habitually reside. As a consumer you may bring proceedings before the courts of your place of residence.

13. Miscellaneous

If a clause of these terms is held invalid, the rest continues to apply. Our failure to enforce a clause is not a waiver of it. These terms, together with our shipping policy, refund policy and privacy policy, form the whole agreement between us for your order.
